Not ones for sculptures that are five hundred years old!  It's a stupid, tasteless ad, but now I hope the company keeps it up just to spite Italy's dumb e-lawyering.  In any case, they're getting a lot more publicity now, thanks to Italy's tripping over the Streisand effect.

I think what happened is that you aren't allowed to take photos of David when you visit. So the photo must have come from the Italian government and they hold copyright of the photos. Not the statue.

But is it not the image as in the photo? Not David's image. David is long dead as are his close relatives. Anyhoo, speculation on my part but the Italians say its copyright infringement so I'm guessing it must be from the photo.

It's the statue itself that's copyrighted.  One of the exclusive rights that copyright holders have is public display of their work through photography or video/audio recording.  Of course, another element of copyright is that it expires after seventy years, so clearly the Italians do things a little differently to us, but it doesn't seem likely that they would be more lenient than us in any element of the law.

Italy is broke. If they can screw a gun manufacturer over for a few dollars I'm sure they will. And who would feel sorry for a weapons manufacturer? Especially a stupid one that makes dumb adverts.
