You're right, this is disgusting. I mean, that's not even well done art, what were they thinking? Shameful.

The Italian government has copyright on the use of images of David. Maybe you should have actually read the link I provided?

The Italian government has copyright on the use of images of David.

Did Michelangelo give them permission for that?

Michelangelo doesn't own the statue.

What's funny to me is that:
1. They had to cover the penis, degrading the "work of art".
2. The statue is Italian made by an Italian and yet they're promoting proud american made.  Kind of a mixed message.

They should have used lady liberty.  But then again, that's French made.

It is odd you can show a 6 foot sniping rifle but not a statue's penis in America. You are a very strange country.

In America we believe that a penis will scar children for life while a gun I something they pretend to play with.

Shockingly enough, Italian law doesn't actually apply to America.

International copyrights do.

But apparently the government does and can claim rights to it. That's what's disgusting here.

Why is it disgusting that the statue is owned by the people of Italy? I can't think of anyone else better to own it.

International copyrights do.

Not ones for sculptures that are five hundred years old!  It's a stupid, tasteless ad, but now I hope the company keeps it up just to spite Italy's dumb e-lawyering.  In any case, they're getting a lot more publicity now, thanks to Italy's tripping over the Streisand effect.

Which is why I hope they get sued.

How does one copyright a work of art created hundreds of years before copyright law was invented?  ???

I thought it lasted for 70 years after the artist died.

I reckon the artist has been dead for long enough in this case. ::)

Frankly, if they are going to start adding leaves to David's image then they aren't ready to use his likeness.

Armalite is a great gun manufacturer. David should be happy he got one of their guns for free.

From a practical standpoint, surely that rifle is too big to be used by anyone outside the Metal Gear Solid Franchise?

It's a sniper rifle. You use it while prone.

I was pretending that I didn't know that they'd scaled it up for the ad...

Pretty sure Spongebob made a similar statue (without the gun obviously). Think he asked the Italians for permission?

I think what happened is that you aren't allowed to take photos of David when you visit. So the photo must have come from the Italian government and they hold copyright of the photos. Not the statue.

Do you know the ad was created from a photo and not created by someone in their marketing department from scratch?  It seems they are upset about the image of David being used.

But is it not the image as in the photo? Not David's image. David is long dead as are his close relatives. Anyhoo, speculation on my part but the Italians say its copyright infringement so I'm guessing it must be from the photo.

It's the statue itself that's copyrighted.  One of the exclusive rights that copyright holders have is public display of their work through photography or video/audio recording.  Of course, another element of copyright is that it expires after seventy years, so clearly the Italians do things a little differently to us, but it doesn't seem likely that they would be more lenient than us in any element of the law.

Italy is broke. If they can screw a gun manufacturer over for a few dollars I'm sure they will. And who would feel sorry for a weapons manufacturer? Especially a stupid one that makes dumb adverts.

America loves their weapons manufacturers. Weapons defends their freedom, you know.

David is not intellectual property.  It's much too old.
